Research on delinquency reduction often highlights the importance of identifying and sanctioning antisocial and illegal activities so as to reduce the likelihood of future offending. The rise of digital technology complicates the process of detecting cybercrimes and technology enabled offenses, as individuals can use devices from anywhere to engage in various harmful activities that may appear benign to an observer. Despite the growth of cybercrime research, limited studies have examined the extent to which technology enabled offenses are detected, or the (...) behavioral and attitudinal factors associated with being unobserved or caught for one’s actions. The current study addresses this gap in the literature by estimating a multinomial regression model for self-reported computer hacking behavior and the likelihood of those actions being detected in a large international sample of juveniles (N = 51,059). The findings demonstrate significant differences between youth who hack without detection compared to those who are caught. The implications of this analysis for our understanding of cybercrime and its relationship to traditional delinquency are explored in depth. (shrink)

Can an omnipotent and omnibenevolent God create humans with free will without the capacity to commit evil? Scholars have taken opposite positions on the contentious problem. Using scripture and the rules of logic, we argue that God cannot create impeccable creatures because of his ‘simplicity’. God cannot create gods, because God is uncreated. Peccable humans freely choose to disobey their creator and thus cannot blame him for the horrendous evils in this world. Concerning the belief of sinless humans with free (...) will in heaven, we suggest that such an impartation of God’s impeccability can be accomplished, not through creation, but by the marriage of Christ and the Church, for the two shall become one. Believers will become children of God and partakers of the divine nature.Contribution: Theologians and philosophers have argued whether God could create humans with free will who never commit evil, and if he could, why did he not do so? Drug Safety Communications are used by the Food and Drug Administration to inform health care providers, patients, caregivers, and the general public about safety issues related to FDA-approved drugs. To assess patient knowledge of the messaging contained in DSCs related to the sleep aids zolpidem and eszopiclone, we conducted a large, cross-sectional patient survey of 1,982 commercially insured patients selected by stratified random sampling from the Optum Research Database who had filled at least two prescriptions for either zolpidem or eszopiclone (...) between July 1, 2012 and June 30, 2013. Among the 594 respondents, two-thirds reported hearing generally about drug safety information prior to starting a new drug, with the remaining one-third “rarely” or “never” hearing such information. Providers and pharmacists were primary sources of drug safety information. Two-thirds of zolpidem users and half of eszopiclone users reported having heard about the related DSC messages, ability to accurately identify the major factual messages was limited. Respondents reacted to new drug safety information about their sleep aids by reporting that they would want to learn about alternative ways to help them sleep and seek out more information about the safety of their specific sleeping pill. Opportunities may exist for the FDA to work with providers and pharmacies to help ensure the DSC information is more widely received and is more fully understood by those taking the affected medications. While defining martial arts is not prerequisite to philosophizing about them, such a definition is desirable, helping us resolve disputes about the status of hard cases. At one extreme, Martínková and Parry argue that martial arts are distinguished from both close combat (as unsystematic) and combat sports (as competitive), and from warrior arts (as lethal) and martial paths (as spiritual). At the other extreme, mixed martial arts pundits and Bruce Lee speak of combat sports generally as martial arts. I argue (...) that the fine-grained taxonomy proposed by Martínková and Parry can be usefully supplemented by a broader definition, specifically the following: martial arts are systematic fighting styles and practices as ways of embodying wisdom. A possible difficulty here is that such views face the charge of overemphasizing the “philosophical” aspect of martial arts. My definition can, however, avoid this apparent problem. If martial arts essentially aim to embody wisdom, this applies no less to the (strategic) practical wisdom of The Art of War than to the (ethical) practical wisdom of the Tao Te Ching. In an extended sense, then, any systematic fighting style, including combat sports, may count as a martial art insofar as it embodies wisdom by improving practical fighting skills. (shrink)

I consider an alleged example of a non-transitive causal chain, on the basis of which J. Lee has argued that causation is non-transitive. I show that his analysis of the example rests on too coarse-grained an approach to causal relata. I develop a fine-grained analysis of events which owes much to Dretske’s notion of an allomorphic event, and I use this analysis to show that in the example all the genuine causal chains are indeed transitive. In chapters 9 and 10 of their book Roman but Not Catholic, Kenneth Collins and Jerry Walls criticize the Roman Catholic positions on the Eucharist as a sacrifice and on the ministerial priesthood. I reply to their historical and theological objections, and defend the belief that the Eucharistic sacrifice, the Mass, is a re-presentation, or making present, of Jesus’s redemptive sacrifice on Calvary, and a key component in God’s incarnational strategy for redeeming us.

This paper draws upon recent insights into the emergence of issue-focused stakeholder networks which engage in a co-creative process for constructing mutual value. It applies these insights to evaluate Wal-Mart CEO Lee Scott’s “21st Century Leadership” effort to impose an ethical supply chain control system in China. The paper concludes that further institutional innovation is needed to realize the potential of 21st century transformational leadership at Wal-Mart and elsewhere.

Jerry Fodor argues, in The mind doesn't work that way (Cambridge, MA: MIT Press, 2000, that the computational theory of mind is undermined by the pervasive context sensitivity of human cognition. His objections can be easily met, however, by noting the properties of appropriately structured representation hierarchies.

Although philosophers acknowledge the significance of blindsight for theories of mind---indeed, some try to trade on it---they have not given the phenomenon the extended treatment it deserves. In helping to fill this gap, I argue that despite attempts to use it in undermining qualia , blindsight supports realism about qualia, and an identity theoretic account of them. ;In Chapter 1 I argue against attempts by Dennett and the Churchlands to use blindsight in undermining qualia. I complement this by criticizing their (...) more general arguments against qualia. ;In Chapter 2 I argue that blindsight in fact supports realism about qualia. To do so I bring together four separate points from the literature and add to them a fifth, adapted from an observation by Jerry Fodor. ;In Chapter 3 I argue that blindsight is best explained by saying that the qualia patients conspicuously lack are causally involved in normal vision. I also argue that this is not ruled out by principled objections of the usual sort, and is best cashed out by identity-theory. ;In the Conclusion I discuss some of the other areas of philosophical concern on which blindsight has been thought to bear: color-theory, intentionality, theories of knowledge, and issues in perception. A bedrock assumption made by cognitivist philosophers such as Noam Chomsky, and, more recently, Jerry Fodor and Steven Pinker is that the contexts within which children acquire a language inevitably exhibit a irremediable poverty of whatever stimuli are necessary to condition such acquisition and development. They argue that given this poverty, the basic rudiments of language must be innate; the task of the cognitivist is to theorize universal grammars, languages of thought, or language instincts to account for it. My (...) argument, however, is that this assumption is philosophically suspect in that it assumes an untenably Cartesian conception of "stimulus" which itself presupposes a rigid dualism of subject-user and context and hence confuses the underdetermination of stimulus for its lack. I argue that the former does in fact provide the necessary conditions for language acquisition. I then go on to develop a Wittgensteinian—Dennettian model within which underdetermination plays a key role. (shrink)

This paper reports laboratory data for games that are played only once. These games span the standard categories: static and dynamic games with complete and incomplete information. For each game, the treasure is a treatment in which behavior conforms nicely to predictions of the Nash equilibrium or relevant refinement. In each case, however, a change in the payoff structure produces a large inconsistency between theoretical predictions and observed behavior. It has been a popular theory in English, Japanese, and Chinese scholarship that a “victory of Confucianism” occurred during the Han dynasty. Some members of these academic communities challenge this theory. However, it has long been overlooked that they do so by adopting different terminology and research frameworks. English scholarship uses the expression “victory/triumph of Confucianism” to refer to the dominance or growth of Confucianism during that period, while the Japanese use “the establishment of Confucian doctrine/religion as the state doctrine/religion” (...) and the Chinese use “dismissing the hundred schools and revering only the Confucian arts”. The expressions, as the current issue illustrates, exemplify three different ways of studying the history of Han Confucianism. (shrink)

Executives of many publicly held firms agree to compensation packages that create immense exposure to their employer’s stock. Corporate boards, aspiring to motivate executives to make value-maximizing decisions, often tie an executive’s earnings to stock price performance through stock or option awards. However, this engenders a significant ethical dilemma for many executives who are uncomfortable with sizable, firm-specific risk and desire to reduce it through hedging activities. Recent research has shown that executive hedging has become more prevalent. In essence, managers (...) are unwinding the acute economic incentive to act in the best interest of the owners. This appears to violate the spirit of the compensation contract and from a normative standpoint, is not how executives should act. In this article, we describe how some executives are acting in regard to this issue (descriptive ethics), how they should act (normative ethics) and how they can be helped to get from what they are doing, to what they should be doing (prescriptive ethics). In this paper, the author reflects on why students so frequently have the false intuition that statements like (i) “If someone is a criminal then he comes from a single parent family,” imply their converse, namely (ii) “If someone comes from a single parent family then he is a criminal.” The author argues that this intuition is not baseless. In everyday speech, conditional statements very often refer to finite populations, meaning that while (i) does not imply (ii), (i) stands in (...) an evidential relationship to (ii). That is, given a finite population, (i) implies that if someone comes from a single family home, it is more probable that he is a criminal. While teaching first order logic, however, conditional statements are treated as referring to infinite samples, which renders the evidential relationship insignificant. The author concludes by addressing why these differing interpretations of conditional statements should be taken into account when teaching logic. (shrink)

This article uses a Lacanian framework both to map types of posthuman discourse that shape the debates around science, technology and the fate of the human, and to advocate a more psychoanalytic framing of these debates. It identifies three dominant posthumanisms: ‘doomsday’, ‘celebratory’ and ‘critical’. The first adopts an apocalyptic tone in the defence of a supposedly natural human essence; the second unthinkingly embraces the promise of new technologies for augmenting human potential; the third draws on the critique of humanism (...) to balance the first two tendencies. The article then proposes a ‘fractal’ reading of both Freud and Lacan which updates psychoanalysis for the online world today. Finally, the article aligns each of the types of posthumanism with one of Lacan's ‘four discourses’: ‘doomsday’ posthumanism with the discourse of the hysteric, ‘celebratory’ posthumanism with that of the master, and ‘critical’ posthumanism with that of the analyst, thereby putting psychoanalysis at the centre of the posthuman rather than its margins. Criminalistics laboratories routinely provide cold hits in police investigations by comparing DNA profiles from crime scenes to offenders residing in the Combined DNA Index System. Forensic DNA analysis is often glamorized in popular culture, where the perpetrators are identified and crimes solved within a single television episode. In reality forensic DNA hits can identify perpetrators of violent offenses, link multiple crimes committed by the same individual, or exclude suspects and exonerate the falsely accused. Unlike the media portrayals, downstream activities after (...) a DNA identification or cold hit are often more complex. While the Federal Bureau of Investigation cites a national Data Bank of more than 7.2 million DNA profiles and 94,000 identifications nationwide, an in-depth analysis of public safety improvements made with CODIS is currently unavailable to forensic practitioners and public policy analysts. A review of case resolutions for 198 DNA database hits in San Francisco created performance metrics to provide a concrete measure of the effectiveness of DNA databasing efforts at the city and county level. This paper focuses on the so-called Borda approach to decision making under normative uncertainty (MacAskill, Mind 125(500):967–1004, 2016 ; MacAskill et al., Moral uncertainty, Oxford University Press, 2020 ) and illustrates how an extended version of it aimed at accommodating incomplete preference orderings associated with normative theories fails. I propose a different account for (...) proponents fond of the voter-theoretic approach that is grounded by _approval voting_, which sufficiently addresses the problem of option incomparability and is pragmatically compelling due to its simpler structure.
